BLOOMS247 PTY LTD operates flower vending machines and related retail services in Australia. Our services may include online enquiries, in-person purchases, vending machine purchases, customer support, advertising, promotions, and related digital services.

1.3 Changes to these Terms

We may update these Terms from time to time. The updated version will apply from the date it is published on our website. Your continued use of our website or services after changes are published means you accept the updated Terms.

1.4 Website information

The content on our website is provided for general information only. We aim to keep information accurate and current, but we do not guarantee that all website content is complete, error-free, current, or available at all times.

Product images, colours, flower arrangements, packaging, sizes, and availability may vary due to seasonal supply, stock availability, lighting, display settings, and the natural variation of flowers.

1.5 Product availability and substitutions

Flowers are seasonal and perishable. We may substitute flowers, foliage, colours, wrapping, packaging, or arrangement components where a product or component is unavailable.

Where substitution is required, we will use reasonable efforts to provide a product of similar style, value, and overall presentation.

1.6 Pricing and payment

All prices are in Australian dollars unless stated otherwise.

Prices may change without notice. The price payable is the price displayed at the time your order is placed or the price shown at the vending machine point of sale.

You must provide accurate payment information. We may refuse, cancel, or delay an order if payment is declined, suspected to be fraudulent, incorrectly processed, or otherwise invalid.

1.7 Orders and acceptance

Submitting an order does not guarantee acceptance. We may refuse or cancel an order where the product is unavailable, payment cannot be processed, the order contains incorrect information, there is a pricing or product description error, we suspect fraud or misuse, fulfilment is not commercially or operationally reasonable, or we are required to do so by law.

If we cancel an order after payment has been made, we will provide a refund to the original payment method unless otherwise agreed.

1.8 Vending machine purchases

For vending machine purchases, risk in the product passes to you once the product is dispensed or made available for collection.

You are responsible for checking the product promptly after purchase.

1.9 Perishable goods, refunds and consumer guarantees

Flowers and floral arrangements are perishable goods. Their lifespan depends on handling, temperature, water, environment, transport, and care after purchase.

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law.

If a product is faulty, not of acceptable quality, not as described, or otherwise fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, or other remedy under the Australian Consumer Law.

Change-of-mind refunds are not guaranteed for perishable goods. We may offer a refund, replacement, or credit at our discretion where appropriate.

To request support, contact us at contact@blooms247.com.au within 24 hours of purchase and provide your name, order number or receipt, purchase location, clear photos of the product, details of the issue, and your preferred contact method.

1.10 Customer responsibilities

You must provide accurate contact and payment details, use our website and services lawfully, not interfere with our website, vending machines, payment systems, security systems, or operations, not use our website or services for fraud, spam, scraping, hacking, or unlawful conduct, not upload or transmit malicious code, and not misuse promotions, discount codes, referral offers, or loyalty programs.

1.11 Promotions, discounts and offers

Promotions, discount codes, giveaways, loyalty benefits, and special offers are subject to any specific terms stated at the time of the offer.

Unless stated otherwise, offers are not transferable, cannot be exchanged for cash, cannot be combined with other offers, may be limited by location, product, time, quantity, or customer group, may be withdrawn or changed at any time, and may be refused where we reasonably suspect misuse or fraud.

1.12 Gift messages and user content

Where you submit gift messages, reviews, feedback, photos, comments, or other content, you warrant that the content is lawful, accurate, and does not infringe any third-party rights.

You must not submit content that is offensive, misleading, defamatory, discriminatory, abusive, obscene, threatening, unlawful, or otherwise inappropriate.

We may remove or refuse to publish user content at our discretion.

1.13 Intellectual property

All content on our website and in our marketing materials, including text, images, graphics, logos, designs, videos, product names, layout, branding, and software, is owned or licensed by BLOOMS247 unless stated otherwise.

We do not control third-party websites or services and are not responsible for their content, policies, security, availability, or practices.

1.15 Advertising, analytics and tracking technologies

We use cookies, pixels, tags, and similar technologies for website functionality, analytics, advertising, retargeting, conversion tracking, performance measurement, fraud prevention, and improving our services.

These technologies may include Meta Pixel and Meta advertising tools, Google tags, Google Analytics, Google Ads conversion tracking, TikTok Pixel and TikTok advertising tools, and other analytics, marketing, payment, security, or website service providers.

1.16 Marketing communications

We do not currently send marketing emails or marketing SMS messages.

If we introduce email or SMS marketing in the future, we will update our policies where required and will only send marketing communications where permitted by law. Any marketing emails or SMS messages will include a way to unsubscribe.

Service messages, transactional messages, receipts, support replies, safety notices, and important operational communications may still be sent where legally permitted.

1.20 Limitation of liability

To the maximum extent permitted by law, BLOOMS247 is not liable for any indirect, incidental, special, consequential, or economic loss, including loss of profit, revenue, goodwill, data, opportunity, or business interruption.

Where liability cannot be excluded, our liability is limited, where permitted by law, to replacement of the goods, supply of equivalent goods, repair of the goods, payment of the cost of replacing or repairing the goods, or refund of the amount paid for the relevant goods or services.

Nothing in these Terms excludes any liability that cannot be excluded under Australian law.

1.21 Indemnity

You agree to indemnify BLOOMS247, its directors, employees, contractors, agents, and service providers against loss, damage, cost, liability, or expense arising from your breach of these Terms, your misuse of our website, products, vending machines, or services, your unlawful conduct, your infringement of third-party rights, or inaccurate, misleading, or fraudulent information you provide.

1.22 Force majeure

We are not liable for delay or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, severe weather, transport issues, supply chain disruption, venue restrictions, government action, strikes, system outages, payment provider failures, cyber incidents, pandemics, or other events outside our control.

1.23 Governing law

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from those courts.
